Writing a contract of employment

When writing a contract of employment there are a number of different contracts that you can choose from depending on the position, these are:
- Short term
- Fixed term
- Open ended
- Service
- Temporary
- Relief/Casual
- Zero hours
- Key time
- Full time
- Part time
- Permanent
- Annual hours
- Job Share
As a minimum you should you issue a statement of particulars within two months of employment commencing, this should include as a minimum
- Name of employee and employer
- Date employment began
- Date continuous employment began
- Scale, rate or method of calculating remuneration
- Pay interval and level
- Hours of work
- Holidays and holiday pay
- Terms and conditions relative to incapacity due to sickness or injury, including any sick pay provision
- Pensions and pension scheme
- Notice requirements
- Job title or a brief job description
- Where a job is temporary, the period it is expected to last, or for a fixed term contract, the date it will end
- Place of work or, where the employee is to work at various locations, an indication of that and of the employers address
- Any collective agreement which directly affect the terms and conditions including, where the employer is not party to the agreement, the persons by whom they were made
Where there are no particulars to be entered, this should be stated. With limited exceptions, for employers of fewer than 20 employees, the statement must also contain a note specifying:
- Disciplinary rules
- A person to whom the employee can apply if dissatisfied with a disciplinary decision and the application can be made
- A person with whom the employee may raise a grievance and how this should be done
- The procedure for pursing disciplinary challenges and grievances further
- Whether contracting-out certificate is in force for the employment
You can issue the particulars in instalments however the following items should be included in one document, otherwise known as the ‘principal statement’
- Name of Employer and employee
- Date employment began
- Date continuous employment began
- Pay and pay interval
- Hours of work
- Holidays and holiday pay
- Job title or job description
- Place of work
